Untitled Document This agreement made this 29th day of June 1857 between Samuel C. Pomeroy of the City of Atchison Kansas Territory of the first part and Theodore Hyatt of the City of New York party of the second part. Witnesseth that said party of the first part in consideration of one dollar to him in hand paid. The receipt whereof is hereby acknowledged and of the conditions hereinafter mentioned hath agreed and by these presents doth agree to convey unto the said party of the second part the undivided half of all the following property viz!

Title to Lot No. 4 in Block No 9 on Map of Atchison

“ to Lot “ 3 on Block No. 21
““1 ““ No 1 with building thereon

Title to Lots No. 10.11.12 on C. Street Block No (Smith Purchase)

Also undivided half of said Pomeroys one quarter interest in the Abell and Stringfellow [xxxxx] for Lands adjoining the Town of Atchison on North side thereof comprising 335 acres;

Also Title to Fifty Lots as follows viz on Map of Atchison

Also the one undivided half of said Pomeroys Title to 181 6/100 acres of Land lying opposite Atchison in the State of Missouri purchased of Million together with the building thereon including the Saw Mill and one Yoke of oxen and the crops on the ground, also the one undivided half interest of said Pomeroy in the Lease of said properties lately held by one having 5 Years yet to run but purchased from said by said Pomeroy for the sum of $3,500 which Lease carries with it the building on the ground –

Also the one undivided one half of said Pomeroy interest in the Squatter Sovereign together with its losses and profits –

Also the one undivided half of said Pomeroy interest in three several claims (when obtained) adjoining or near said City of Atchison owned respectively by Dicksen, Abell and Chaliss –

Now the conditions of the above obligations are as follows viz: said Theodore Hyatt having paid to the said Pomeroy Five Thousand Dollars in cash the receipts whereof is hereby acknowledged doth agree also to pay to said Pomeroy Eight Thousand and Twenty-Seven Dollars and Twenty-One cents, as follows viz: $250.00 on the 25th day of August next ensuing -- $525.00 on the 17th day of October next -- $833.33 on the first day of August next -- $125.00 on the 29th day of July next -- $200.00 on the first day of October next -- $3,789.75 on the Seventh day of May 1858 -- $500.00 on the first day of January 1858 – and One Thousand Eight-Hundred and four Dollars and sixteen cents on demand –

Also the said Hyatt agrees to pay unto the said Pomeroy the one half of all monies necessary to secure

the three outside claims above alluded to at such times and in such amounts as may be needed to effect the same –

It is also hereby mutually understood and agreed between the parties to these presents that any lands adjoining the Missouri purchase that may from time be obtained by either party shall at the option of the other be equally owned between them, each paying his proportionate share of the investment.

It is also mutually understood and agreed between the parties to these present that the Contract now existing between Samuel C. Pomeroy and Willis E. Gaylord respecting the purchases of lands shall be binding upon the parties to these present equally –
